PREAMBLE

The website www.iokiparis.com (hereinafter referred to as "the Site") is published by the company SAMA SASU, with capital of 3000.00 euros, whose head office is located at 13 sente la France, 92370 Chaville, and registered in the NANTERRE trade and companies register under number 891 744 526.

The purpose of these General Conditions of Sale is to define the rules applicable to the sale of products marketed on the Site (hereinafter “the Product(s)”).

Any natural person, of legal age, non-commercial, having the legal capacity to contract, domiciled exclusively in the countries served by www.iokiparis.com (hereinafter "the Customer") and making a purchase of a Product on the Site.

For the purposes hereof, it is agreed that the Customer and IOKI shall be collectively referred to as the “Parties” and individually referred to as the “Party”.

These general conditions (hereinafter the “General Conditions of Sale”) govern the unrestricted sales of Products made by IOKI from the site.

IOKI reserves the right to modify these General Conditions of Sale at any time by publishing a new version on the Site. The applicable General Conditions of Sale are those in force on the Site on the date an order is placed by the Customer; it being understood that any order for a Product placed on the Site binds the Customer to the General Conditions of Sale in force at the time the order is placed.

Article 1: object

The purpose of these General Conditions of Sale is to define the conditions under which the Products are marketed by IOKI to the Customer. They cover the different stages of sales progression: from the moment the Customer places their order until delivery to the Customer.

Article 2 - PRODUCTS

The products offered for sale by IOKI are those which appear on the website on the day of their consultation by the Customer; it is understood that the photographs illustrating the products are not contractual. Each product will be the subject of a description which, in addition to the photograph, will include: the price, the size or dimensions, the colors available, the compositions and any special characteristics. Slight differences may exist between products, as well as between the product and its photograph, depending on the screen resolution and color definition of the user's computer.

IOKI is committed to providing products that comply with applicable safety and health regulations, in accordance with European provisions, and in particular the legislation on chemical regulations.

IOKI specifies, however, that the majority of "IOKI" products are made by hand, which may result in slight deformations and differences which cannot be considered as defects.

Article 3 - PRICE

Prices are indicated in euros, all taxes included and excluding delivery costs; it is understood that the value added tax applied is that in force in French metropolitan territory on the day the order is validated. The prices applied are those indicated on the site and confirmed when the Customer validates their order. Delivery costs are indicated on the order summary before the Customer confirms it and include all French taxes. These costs are the responsibility of the Customer and are invoiced in addition to the sale price of the Products. The transfer of risks of loss and damage to the Products will take place after delivery and receipt of the Products by the Customer. We reserve the right to modify our prices at any time, but we will apply the current prices as indicated to you on the site at the time of placing the order. We would like to inform you that if a clearly incorrect price appears on our website (a price that is clearly too low, for example), for whatever reason (computer bug, human error, technical error, etc.), your order will be canceled, even if it was initially validated.

Article 4 - ORDER & PAYMENT

  • 4.1 PLACE AN ORDER

The Customer places his order by following the following 5 steps:
Step 1: The Customer selects the desired Products and adds them to the basket after selecting, where applicable, the desired size and color. The basket at the top right of the screen indicates to the Customer that he has made his selection by indicating the number of Products it contains.

Step 2: The Customer can check the contents of his basket by clicking on “order” to access the summary of his order. The Customer can modify his order (Product, size, quantity).

Step 3: Once the order has been verified and, if necessary, modified, the Customer validates their basket to finalize their order by clicking on “order” again. If the Customer has a promotional code reserved for the best customers, he must enter it in the space provided for this purpose in order to benefit from this promotion.

Step 4: Customer enters delivery and billing information. In addition to the date of birth, address and delivery information, it is necessary that all fields are completed for the order to be finalized; Unless the Customer gives different instructions, the billing address will automatically be the same as the delivery address. Depending on the delivery address, the total amount of the order, including taxes, is indicated in the summary and is distinguished by the price of the Products and the delivery costs. If the Customer has already ordered on the site, he has a customer account. In this case, he can identify himself using only his email address and password. The Customer then checks all the information and clicks on “validate” to track their order. The Client expressly undertakes to provide complete and accurate information. In the event of an error in writing the delivery address or incomplete information making delivery of an order impossible, the IOKI company cannot be held responsible.

Step 5: Entering bank details. The Customer then accesses the secure payment screen with the IOKI partner, as specified in article 4.3 below. Payment made online is only made by credit card (Visa, Mastercard, Carte Bleue or Paypal ). The Customer must enter their credit card number, the expiry date as well as the 3 visual cryptogram numbers appearing on the back of the card, understanding that in the case of payment with an American Express card, the Customer must enter 4 digits. If the payment is accepted, the Customer will be redirected to the screen where the order is confirmed on the site. In the event that the payment fails, the Customer will have up to 3 attempts to re-enter their bank details. After the 3rd attempt, the Customer will be redirected to a screen on the site indicating payment refusal. The Customer will be invited to contact IOKI customer service to find out the reason for non-payment and find a solution in order to finalize the order.

  • 4.2 ORDER CONFIRMATION

As soon as payment is accepted, the Customer will receive an e-mail confirming their order, summarizing the items ordered, the billing and delivery address as well as the delivery date. The validation of the order by the Customer and the confirmation of the order are sent to the Customer by e-mail by IOKI following acceptance of payment and conclude a sales contract between the Parties as well as acceptance of the General Conditions of Sale . The Customer who has placed an order will receive his invoice by e-mail. IOKI reserves the right not to validate an order in the following cases: abnormal or abusive complaints, abnormal orders with regard to the quantities ordered, abnormal or abusive exchanges or returns, ongoing disputes with the Customer. www.iokiparis.com customer service is available for all questions relating to the Customer's order.   • 4.3 PAYMENT

The price of the Products purchased is payable in cash, in full, on the day the Customer places their order. Payment is made online with a bank card (credit card, Visa) or Paypal when the order is confirmed by the Customer. The request for direct debit from the card is made when the order is validated on the site, unless the servers are unavailable.
IOKI reserves the right to make a new direct debit request in the event that the first request was unsuccessful due to the unavailability of the servers. In the event of non-payment, incorrect address or any other problem with the Customer's account, IOKI reserves the right to block the Customer's order until the problem is resolved. In the event of fraudulent use of their credit card on the site, the Customer is invited to contact IOKI at the following number: +33 (0)6 71 55 82 04, Monday to Friday from 9 a.m. to 7 p.m. (GMT +1 time). , excluding public holidays in France) or by e-mail to the following address: hellot@iokiparis.com .
Transactions carried out on the site are secured by IOKI's payment partner, the company STRIPE. All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by a third party. At no time does the Client's financial data pass through IOKI's computer system. STRIPE verifies that the connection with the Customer's browser is secure before sending the payment form to the banking institution carrying out the financial transaction. STRIPE is a technical service and does not handle disputes related to orders, which are handled directly by IOKI as specified above, or where applicable, with the Customer's bank.

  • 4.4 REGISTRATION OF AN ORDER

The confirmation of an order is recorded in IOKI's archives, which are kept on a reliable and durable medium. The Customer accepts that the confirmation of an order is considered proof of the contractual relationship between the Parties.

Article 5 - DELIVERY

IOKI undertakes to do its best to deliver orders within the time indicated in the order confirmation. In order for these deadlines to be respected, the Customer must ensure that they have provided precise and complete information concerning the delivery address. All orders registered on the site from Monday to Friday before 3:00 p.m. will be processed the same day; after 3:00 p.m., they will be processed the following day. All orders placed on Friday after 3:00 p.m., Saturday and Sunday will be processed the following Monday; understanding that orders placed on public holidays will be processed the following business day. In the event of a delivery delay, the Customer will be informed by e-mail as soon as possible. He will also be kept informed by e-mail of new delivery times. For orders destined abroad, when the exported package reaches its destination, the recipient must pay any taxes or customs duties applicable in the destination country. Local authorities can provide this information.

Article 6 - RECEIPT OF THE ORDER - COMPLAINTS - RETURNS

To the extent permitted by applicable law, IOKI assumes no liability for any direct, indirect, incidental, special, consequential or exemplary damages arising out of the use of or inability to use the products or services provided. This includes, but is not limited to, damages for lost profits, business interruption, loss of information, or any other pecuniary loss, even if IOKI has been advised of the possibility of such damages.

IOKI shall not be liable for any delay, failure to perform or non-compliance with obligations arising from the contract, where this is due to circumstances beyond its control, including, but not limited to, force major events such as natural disasters, strikes, technical breakdowns, transportation problems or legal restrictions.

In any event, IOKI's total liability to the Customer, regardless of the cause or form of action, is limited to the amount actually paid by the Customer for the products or services concerned.

The Customer acknowledges and accepts that these limitations of liability form an integral part of the contract between the Parties and that they apply to the fullest extent permitted by applicable law.

Article 9 - FORCE MAJEURE

In the event of the occurrence of a force majeure event, the Parties are released from their contractual obligations for the duration of this event and to the extent of its impact.

Force majeure events include, but are not limited to, natural disasters, fires, floods, wars, acts of terrorism, riots, strikes, major technical failures, acts of governmental authorities, as well as any other unforeseeable and insurmountable event beyond the reasonable control of the Parties.

In the event of the occurrence of a force majeure event, the Parties must inform the other Party immediately and in writing, specifying the nature and impact of the event. Contractual obligations will be suspended for the duration of the force majeure event.

If the force majeure event continues for an extended period, each Party has the right to terminate the contract without incurring liability to the other Party.

The Parties agree to make all reasonable efforts to mitigate the effects of the force majeure event and to resume performance of the contractual obligations as soon as this becomes reasonably possible.

Force majeure does not entitle any party to claim damages or compensation for any loss suffered as a result of the force majeure event.

Article 10 - APPLICABLE LAW

If any of these General Conditions of Sale is deemed invalid, illegal or unenforceable by a court, the other provisions of these General Conditions of Sale will remain in force.

These General Conditions of Sale are governed and interpreted in accordance with French law.

In the event of a dispute, the customer must first contact IOKI in order to find an amicable solution. Failing this, the courts of common law have exclusive jurisdiction.
